conditions

1. Object of agreement
The following general terms and conditions apply to
all orders and transactions through our online shop. By placing
an order the customer agrees to these terms and conditions. Different or
complementary terms and conditions need an explicit written agreement from
UNIQUE OPALS.
2. Contract formation
The contract between the customer and UNIQUE OPALS
will be formed by the customer’s order and its acceptation by UNIQUE OPALS. The
customer may place an order by phone, by fax, by email, in writing or online
through the
internet. UNIQUE OPALS accepts the order by sending the customer an order
confirmation or by delivering the ordered products.
3. Array of products
We try to provide an accurate description of all
offered products, errors excepted. This description does not imply or warrant
that these products will be available at any time. Prices are subject to change
without notice. Therefore all information and specifications provided are
without any engagement. We disclaim any liability for consequential damages, for
breach of any expressed or implied warranty including merchantability or fitness
for purpose and any liability or responsibility for any errors or omissions in
the content of the site.
Payments are usually accepted by
PayPal, by Visa, MasterCard
and American Express credit cards and by bank-to-bank transfer. PayPal and credit card
payments are directly processed through PayPal (you do not need a PayPal account to
pay by credit card). This way we never see your credit card details and can
provide you additional security for a safe payment as per PayPal policies. To
prevent fraud we require for credit card or PayPal payments that the bill-to
address and the shipping address are identical and reserve the right to refuse
certain payment methods if this seems advisable. All orders must be paid for
within 7 days. Otherwise we have the right to cancel the sale.
We ship worldwide offering a low flat rate of CHF 9.90
for insured shipping of all your combined items by registered priority air mail. Your items
are usually shipped within 2 business days of receiving cleared payment. The
delivery takes usually 1 to 2 weeks. Please contact us if you have not received
your items within 3 weeks. For insurance reasons please check the items
immediately upon arrival and complain any damage or loss right away.
6. Import taxes and duties
You are responsible for import taxes and duties your
country's government imposes. We have no control over these. Please check your
country's policies prior to purchasing.
7. Retention of title
All delivered products remain vested in UNIQUE OPALS
until full payment is received. In case of delay in payment we have the right to
cancel the sale and reclaim the products.
100 % customer satisfaction is important to us.
Therefore we accept returns without giving any reason for an exchange or full refund less shipping costs
and transaction fees. For this purpose the customer has to inform UNIQUE OPALS
within 7 days of delivery in order to receive instructions on how to
return the products. Within further 7 days all products have then to be
returned according to the sent instructions in their original packing and in the
same, undamaged condition as they were shipped. Please note that all costs and
risks associated with the returned products are carried by the customer. This
includes, but is not limited to shipping, insurance, import duties, customs
handling, loss and damage. Please understand that there is no refund or exchange
on customized products and rough opal.
All software and information, text and visual
(including design), are either property of UNIQUE OPALS or used with permission
and are protected by copyright. They may not be used except as permitted in
these terms and conditions or in the text on the site. You may print information
out for personal use, but it may not be copied, distributed or otherwise
reproduced without written permission of UNIQUE OPALS.
10. Privacy
UNIQUE OPALS respects the Swiss data privacy act. Your
personal details are kept highly confidential and are used only to process your
orders. We do not pass on any of your personal information to a third party
unless specifically authorized by you to do so.
11. Place of jurisdiction and applicable law
The current general terms and conditions and the
contracts that were made based on these terms and conditions are subject to
Swiss law. Place of jurisdiction is Pratteln BL, Switzerland.
12. Final provision
For a specific sale transaction that version of the
general terms and conditions is authorized that was valid at the time of order.
If individual terms should be or become void it has no effect on the validity of
the other terms. These general terms and conditions remain subject to change
without notice.
